List of Deficiencies


The list of deficiencies may be taken as a decision support in the assessment of deficiencies for dangerous goods shipments, which are found during inspections of their legal conformity.


The list of deficiencies was developed to support Dangerous Goods Inspectors performing their routine dangerous goods shipment inspections, therefore the categorization may not be used without further evaluation in case of criminal proceedings. It must be evaluated independently, if the deficiency is a violation against dangerous goods regulations and how, if applicable, the violation has to be categorized within the legal framework.

 

If the violation against dangerous goods regulations could cause fatal or serious injury to a person or major property damage.

If the violation against dangerous goods regulations could cause  serious injury to a person or property damage.

If the violation against dangerous goods regulations has a low risk to cause injury to a person or property damage.

General advices for categoziation

  1. Deficiencies, which can not be properly categorized (essential information missing to categorize a category I violation) have to be treated as a category I violation until the required information is available.
  2. On-the-spot measures are acceptable, e.g. to hand in a corrected Shipper’s Declaration later, by the freight forwarder, or shipper.
  3. If, due to safety concerns, a possible risk has been taken into account for classification, and thus the danger was classified higher as it actually was, it may not be objected. E.g. packing group, borderline cases regarding dangerous characteristics (flashpoint, …)
  4. Formal deficiencies, which are not shown in the List of Deficiencies and which do not pose a risk for the safe transportation may be categorized in category III.
