Based on the regulation Assessment Procedures for Language Proficiency according to VO (EU) N° 1178/2011 Annex I (Part-FCL) FCL.055 (e) (ZPH FCL 7) exams for Language Proficiency are to be held via and supervised by certified LABs (Language Assessment Bodies) only.

CAN FCL 1 (ATO approval according to Part-ORA) published in its revision 1
The Civil Aircrew Notice (CAN) FCL 1 regarding the approval of approved training organisations (ATOs) according to regulation (EU) No 1178/2011 and the requirements for ATO manuals was published in its revision 1 (13.11.2013). Significant amendments can be found in chapter 4 and its appendices (ATO approval form and manual compliance checklists) as well as in chapter 5.2 (additional information regarding the requirements for the safety management system).

Austro Control GmbH herewith releases the OPERATIONS INFORMATION LETTER 12/2013 “Issue and record keeping of Cabin Crew Attestations”.
The Information is based on regulation (EWG) No 3922/91 as amended by REG (EC) No 859/2008 to be replaced in the near future by REG (EC) No 965/2012 together with REG (EC) No 290/2012 and is related to operators with cabin crews involved in commercial operation.

Civil Aircrew Notice (CAN) FCL 2 - Introduction of „Aircrew Regulation“ - Revision 2 published
The Civil Aircrew Notice FCL 2 (GZ LSA 320-01/02-13) laying down provisions for the introduction of Regulation (EU) No 1178/2011 (“Aircrew Regulation”) has been published in its revision 2. Significant changes are specified below:
- Item 4.2.1: Possibility of application of the provisions regarding the new mountain rating without prejudice to the “Opt-out” until 08.04.2015
- Items 4.3.4a and 4.3.4b: Applicability of Part-FCL provisions to instructor and examiner certificates for aircraft according to Regulation (EG) No 216/2008 Annex II including rules for exemptions in special Item
- Item 4.3.5a: Use of type rated Annex II aircraft for respective type rating training
- Item 4.4.3: Alleviation for the conversion of JAR CRI and CRE certificates for single pilot high performance complex aeroplanes into respective TRI and TRE certificates according to Part-FCL including the privileges to act as TRI or TRE in multi-pilot-operation (prove of respective experience)

New CAN for the performance of the „On-the-Job training“
Commission Regulation (EU) No 1149/2011 of 21.10.2011 amending Commission Regulation (EC) No 2042/2003 of 20.10.2003 revised the „On-the-Job Training“ as a requirement to issue a license for certifying staff according (EC) No. 2042/2003 Annex III (Part-66) in Appendix III point 6 “On-the-Job Training”.
The Civil Aircrew Notice (ACG) ZPH GEN 2 and appendices rules the implementation and performance of the “On-the-Job Training” in maintenance organizations according (EC) No 2042/2003 Annex I (Part-M/Subpart F) or (EC) No 2042/2003 Annex II (Part-145).

ZPH FCL 2: Veröffentlichung der Revision 1 ==> only in German available
Der Zivilluftfahrtpersonal-Hinweis FCL 2 (GZ LSA 320-01/02-13), mit welchem Festlegungen im Zusammenhang mit der Einführung der VO (EU) Nr. 1178/2011 („Aircrew Regulation“) getroffen werden, wurde in seiner Revision 1 veröffentlicht. Die einzige Änderung betrifft das Kapitel 4.2.1 dahingehend, dass die vorzeitige Anwendung der Bestimmung in Anhang 1 zur „Aircrew Regulation“ (Teil-FCL) FCL.820 (Testflugberechtigung) sowie des Abschnitts K Kapitel 11 (Testfluglehrberechtigung) nicht bereits ab 08.04.2013 erfolgen kann. Im Interesse einer gesicherten und einheitlichen Rechtsanwendung wird unter Ausnützung der „Opt-out“-Frist bis 08.04.2015 eine diese Testflugberechtigungen betreffende derzeit noch in Bearbeitung befindliche Änderung der VO (EU) Nr. 748/2012 („Part-21“) abgewartet.

Online Publication - Airworthiness Directives
Starting with April 12th, 2013 Austro Control GmbH publishes current Airworthiness Directives online. This list contains all international Airworthiness Directives (AD), which were published since January 1st, 2009. It takes into account those aircraft models, which were registered in the Austrian aircraft registry on the issue date of the Airworthiness Directive. Furthermore, the list contains all Airworthiness Directives, which were issued by Austro Control GmbH prior to September 28th, 2003.

Austausch der JAR-Lizenzen durch PART FCL-Lizenzen

Gemäß Verordnung (EU) Nr. 1178/2011 - Artikel 4 (1) gelten nach JAR-FCL ausgestellte Lizenzen, die ein Mitgliedstaat vor dem 8.4.2013 erteilt oder anerkannt hat, als gemäß dieser Verordnung ausgestellt. Die Mitgliedstaaten ersetzen diese Lizenzen spätestens bis 8.4.2018 durch Lizenzen, die dem in Teil-ARA festgelegten Format entsprechen.
Seitens der Austro Control GmbH wird zur Klarstellung darauf hingewiesen, dass das auf der JAR-Lizenz eingetragene Gültigkeitsdatum der Lizenz, welches vor dem 8.4.2018 liegt, jedenfalls den spätestens möglichen Zeitpunkt für den Austausch auf das neue Lizenzformat gemäß PART-FCL darstellt.
Eine nach JAR-FCL ausgestellte Lizenz, die beispielhaft am 15.4.2013 ihre Gültigkeit verliert, müsste somit vor diesem Zeitpunkt durch eine Lizenz nach PART-FCL ausgetauscht werden. Ein entsprechender Antrag ist daher rechtzeitig an die Austro Control GmbH zu richten.
Wir ersuchen daher alle Lizenzinhaber auf das Gültigkeitsdatum ihrer gemäß JAR-FCL ausgestellten Lizenzen zu achten und mit der Austro Control GmbH in Kontakt zu treten, um den Austausch zu ermöglichen.
Eine Ausübung der mit der gemäß JAR-FCL ausgestellten Lizenz verbundenen Rechte, ist unbeschadet der Tatsache, dass diese nach dem 8.4.2013 als nach PART-FCL ausgestellte Lizenz gilt, nach Ablauf der darin ausgewiesenen Gültigkeit nicht zulässig.

Information für die Besitzer von unbefristeten Anerkennungen ausländischer Zivilluftfahrerscheine

Austro Control möchte nochmals auf die am 01.08.2012 seitens des Gesetzgebers erfolgte Änderung der ZLPV hinweisen: Bitte beachten Sie, dass die Gültigkeit von Anerkennungen ausländischer Scheine, welche von der Behörde ohne Befristung erteilt wurden, mit 01.04.2013 endet.
Anerkennungen von in § 20 Abs. 2 oder Abs. 3 der Änderung der Zivilluftfahrtpersonalverordnung 2006 (ZLPV 2006), ausgegeben am 01.08.2012, genannten ausländischen Scheinen, welche von der zuständigen Behörde ohne Befristung erteilt wurden, sind bis zum Ablauf des 01.04.2013 gültig. Eine neuerliche Anerkennung oder Umschreibung des entsprechenden ausländischen Zivilluftfahrerscheins hat bis zum 08.04.2013 nach dem Regulativ der Anlage 1 (JAR-FCL 1) zur ZLPV 2006, respektive der Anlage 7 (JAR-FCL 2) zur ZLPV 2006, zu erfolgen.
Neuerliche Anerkennungen oder Umschreibungen nach dem 08.04.2013 haben nach dem Regulativ der Verordnung (EU) Nr. 1178/2011 (PART-FCL) zu erfolgen. Die Bestimmungen für die Anerkennung / Umschreibung ausländischer Scheine finden Sie im Anhang III der Verordnung (EU) Nr. 1178/2011.

Important information regarding hand entries on the backside of licences, issued by Austro Control GmbH
According to § 41 LFG, an equality of treatment of all Examiner authorizations, issued according to the regulations of the JAA and Examiner authorizations, issued in Austria, comes into effect. Hence, a pilot, who holds an Examiner authorization, issued by a Member State with “Mutual Recognition”, is allowed to make hand entries on the backside of licenses, which are issued by Austro Control. This procedure is valid until the 8th of April 2013; as by this date the Commission Regulation (EU) No 1178/2011 is coming into force.

MED Workshop
The "Aircrew Regulation" - the new EU regulation concerning air crew - was the center of the MED workshop which was organized together by Austro Control and EASA and took place on the 26th January 2013. The event was held as specialist training course for doctors. About 80 Aero-medical examiners and flight psychologists attended the free workshop and were able to benefit from the combined information. FCL Regional Workshop
The "Aircrew Regulation" - the new EU regulation concerning air crew - was the center of the FCL workshop which was organized together by Austro Control and EASA and took place on the 24th January 2013. The event was very well attended - about 125 people visited the free workshop and were able to benefit from the combined information that was presented among others by the experts of the EASA Matthias Borgmeier and Helen Pietila. Austro Control released Revision 2 of the OPERATIONS INFORMATION LETTER(OIL) 1-2011 comprised changes in the application data. The changes are based on ICAO Annex 6, Part 1 und 3, Amendment 35 (Low visibility operations) and Regulation (EU) No. 965/2012 Annex II, Appendix II.

Change of competent authority for ultralight aeroplanes - Publications by Austro Control
On 15-09-2012 the new provisions of the Regulation for the Jurisdiction of the Austrian Aero Club (§§ 1 Abs 1 Z 2 in connection with 9 Abs 9 of” Österreichischen Aero Club Zuständigkeitsverordnung” - ÖAeCVO, BGBl Nr 394/1994 idF BGBl II Nr 261/2012) came into effect and transferred the jurisdiction for ultralight aeroplane licences from Austro Control to the Austrian Aero Club. Additionally, the Austrian national Civil Air Crew Regulation was amended in such way that the previous rules for ultralight aeroplanes (§ 24 Abs 2 and 4 ZLPV 2006 idF BGBL II Nr 21/2012) were replaced by §§ 24a ff ZLPV 2006 (idF BGBl II Nr 260/2012 - new “Ultralight Licence”). Therefore, the publications for ultralight aeroplanes by Austro Control (Licence regulations and Syllabus according to § 24 Abs 2 und 4 ZLPV 2006) are no longer in force and have been removed from Austro Control’s website.

Prüfervermerke auf Lizenzen - Zivilluftfahrtpersonal-Anweisung veröffentlicht
Die Austro Control GmbH hat für die Vornahme von Prüfervermerken auf Lizenzen (Handeinträge gemäß § 8 Abs 2a bis 2c ZLPV 2006) gemäß § 1b ZLPV 2006 eine Zivilluftfahrtpersonal-Anweisung (ZPA) veröffentlicht, welche detaillierte Regelungen für die Vornahme der handschriftlichen Prüfervermerke enthält. Mit Inkrafttreten der ZLPV 2006 Novelle am 01.08.2012 kommt es zu einer wesentlichen Änderung im Bereich der Flugprüfer, welche Einfluss auf alle Lizenzinhaber hat.
Ab dem Inkrafttreten der genannten Verordnung ist es Flugprüfern gestattet, Verlängerungen von Berechtigungen direkt auf der Lizenz vorzunehmen. Die bisherige Befristung der Eintragung durch den Flugprüfer auf vier Wochen ist obsolet, ebenso wird die Verlängerung nicht mehr alleine durch die Behörde auf der Lizenz eingetragen.

As published on 24th April, 2012, new European Regulations “Aircrew Regulation” came into force. Due to entering the opt-out phase, the application of the “aircrew regulation” is postponed to 8th April 2013. In order to offer support, Austro Control GmbH is organizing two “information days” in late summer 2012 (dates will be announced until end of July). Furthermore a guideline for creating handbooks will be published. After publication of Regulation (EU) 290/2012, which has added new annexes V, VI and VII (regulations for Cabin Crew, Authority requirements and Organisation Requirements) and new “opt-out”-provisions to Regulation (EU) 1178/2011 (“aircrew regulation”), the information letter by Austro Control including the table indicating the deadlines of the transitional periods resulting from the different “opt-out”-provisions (see last page) was updated and is now republished in its new version 3.

Mit Anfang September hat Ing. Franz Graser die Austro Control Abteilung LSA - (Licensing, Search and Rescue und Aeromedical Section) übernommen. Er ist damit unter anderem für die Lizenzierung und die Aufsicht über die Flugschulen verantwortlich, wo aufgrund von europäischen Entwicklungen einige Änderungen bevorstehen. Vorrangiges Ziel wird es sein, die Kunden von Austro Control weiterhin bestmöglich zu informieren und auf die bevorstehenden Herausforderungen gut vorzubereiten. Ing. Graser ist als Vertreter Österreichs in verschiedenen Gremien sowohl bei der EASA als auch in der europäischen Kommission (EASA Committee) mit den aktuellen Entwicklungen auf europäischer Ebene bestens vertraut.

New regulation for the restricted private pilot licence for ultralight aeroplanes according to § 24 ZLPV 2006 - PPL(UL)
Training courses for obtaining a restricted private pilot licence for ultralight aeroplanes commenced on or after 15-01-2011 shall be performend according to the regulations of this syllabus, with the exception of courses which have commenced before 15-01-2011 and will be completed before 15-11-2012 (see: Licensing regulations for restricted private pilots for ultralight aeroplanes, item 1.3.2).

Regulation (EU) No 996/2010 on the investigation and prevention of accidents and incidents in civil aviation
This Regulation came into force on the 2nd December 2010. With immediate effect the Unfalluntersuchungsstelle des Bundes - Fachbereich Luftfahrt has to be notified of accidents (art 2 lit 1) and serious incidents (art 2 lit 16). The obligation to inform the ACG - Zentrale Meldestelle persists.

Results of the Part-145 Round Robin 2008
The results from the Part-145 Round Robin 2008 are now available. There were some areas from improvement in the audited paragraphs 145.A.30 (d) and 145.A.65 (a) and (c) identified. The graphs of the results show the overall result for each audit question due to the fact that the same questions were used for all organisations.

In the future your aircraft could be randomly selected for a ramp check on an airfield by Austrian Aviation Safety Inspectors. This inspection program is a result of the transition from national aviation regulations to the EASA standard (Part M). The program is commonly known as the "fleet survey".

As of March 15, 2009 the amendment of ZLPV 2006 came into force
The principle parts of the amendment refer to the implementation of JAR-FCL 2 into Austrian Law, the implementation of an EU-wide licence for air-traffic controllers and students. Furthermore ICAO language proficiency requirements for pilots and air-traffic controllers were implemented. The amendment also brings a reduction in the aeromedical data the authority has to be provided with by the Aeromedical Examiners.

The changes to VO (EG) 2042/2003 ("Part-M") are in force with 29.10.2008, the ZLLV-Novelle if in force with 28.10.2008.The possibility of an temporary deviation according to M.A.201(i) and Art. 14 (4) of VO (EG) 216/2008 is no longer possible.In General, it is now possible to use an additional one year part M implementation time in General Aviation. This syllabus regulates the instruction for obtaining the private pilot license (PPL) (§ 23 ZLPV 2006) according to the specifications of JAR-FCL 1 Subpart C as well as the concurrent aquirement of a class-rating for a single engined piston airplane with a single pilot.

Renewal of ratings
Expired ratings like class ratings (SEP, SET, MEP), instrument ratings and inactive type ratings (SPA, MPA) can be renewed in compliance with specifications determined by Austro Control GmbH.
The requirements to comply with are oriented on one side by the technical requirements that are associated with the ratings, on the other side by the period of time that passed since expiration of the rating.
Training courses are exclusively held by FTOs oder TRTOs.
These rules are applicable as of January 1, 2009.

Requirements for European Medical Class 3 for Air Traffic Controller
With the upcoming legal validity of the amendment 2008 of the ZLPV 2006, amongst others the legal basis for issuing Medicals for Air Traffic Controllers will change. The existing requirements will be replaced by the “Requirements for European Class 3 Medical Certification of Air Traffic Controllers“ released by the Eurocontrol from 08.02.2006.
The objective release will be renewed by the time of actual validity of the quoted amendment.

EU-OPS: Update of Annex Annex III
The appendix III of the regulation (EEC) No. 1899/2006 has been changed by the regulation (EEC) No. 8/2008 and amended to the regulations of the JAR OPS 1 (Amendment 9 to 12). That means that aviation enterprises operating fixed-wing aircraft have to fulfill the requirements regulated in appendix III till 16 July 2008.

Fuel Tank Safety Training
AMC material to the related Agency Decisions
The Agency Decisions 2007/001/R, 2007/002/R and 2007/003/R reflect the necessary fuel tank safety training for personnel in Part 145 organisations or CAMO's. It is sufficient for the level 1 training (awareness training) to be conducted until end of march 2008 and the level 2 training (detailed training) to be conducted until end of 2010. This training is necessary for aircraft with more than 30 passengers or with more then 3402kg payload.

Implementation of th EC2042/2003 "Fleet Survey"gulation in General Aviation"
One the fundamental responsabilities of the EU civil avaition authorities is the supervision of the airworthiness of registered airplanes. Hence, Austro Control has to introduce a new audit based aircraft sample program beginning with 2006 - the Fleet Survey. This sample program will cover detailed inspections during maintenance visits, ramp checks and in-flight surveys.
